Crown Prince inaugurates environment exhibition

Crown Prince Paras Thursday opened an environment exhibition on Environment Day at the Birendra International Convention Center at which Crown Princess Himani was also present. 

This year's Abraham Conservation Award (ACA) of the World Wildlife Fund for Nature (WWF) Nepal
was given to Lama Karma Sonam Ringpoche of Tashi Lakang monastery in Manang for his effort to protect the endangered snow leopard in the district. 

Other recipients were: Huta Ram Baidya, Inspector Arun Kumar Shah, Ram Prasad Lamsal, Diwakar Prasad Chapagain and Yugal Kishore Thakur, an announcement coinciding with Environment Day said. 

The award carries a purse of Rs.25,000 for individuals and Rs.50,000 for institutions. Crown Prince Paras is Chairman of the King Mahendra Trust for Nature Conservation. nepalnews.com br June 5

PART 7
EXECUTIVE

35. Executive Power:

(1) The executive power of the Kingdom of Nepal shall, pursuant to this Constitution and other laws, be vested in His Majesty and the Council of Ministers.

(2) Except as otherwise expressly provided as to be exercised exclusively by His Majesty or at His discretion or on the recommendation of any institution or official, the powers of His Majesty under this Constitution shall be exercised upon the recommendation and advice and with the consent of the Council of Ministers. Such recommendation, advice and consent shall be submitted through the Prime Minister.

(3) The responsibility of issuing general directives, controlling and regulating the administration of the Kingdom of Nepal shall, subject to this Constitution and other laws, lie in the Council of Ministers.

(4) Except in so far as any action is to be taken in the name of His Majesty pursuant to this Constitution and other laws, all other executive actions shall be expressed to be taken in the name of His Majesty's Government.

(5) Any decision, order or implementation warrant to be issued in the name of His Majesty pursuant to this Constitution and other laws shall be authenticated in such manner as may be set forth in rules made by His Majesty at His discretion. All other decisions, orders and implementation warrants to be issued in the name of the Council of Ministers pursuant to clause (4) above shall be authenticated in such manner as may be set forth in rules approved by His Majesty.

(6) No question shall be raised in any court as to whether or not any recommendation or advice has been given to His Majesty pursuant to this Constitution by the Council of Ministers or any other institution or official, nor shall any question be raised in any court about what recommendation or advice has been given.

PART 20
MISCELLANEOUS

127. Power to Remove Difficulties:

If any difficulty arises in connection with the implementation of this Constitution, His Majesty may issue necessary Orders to remove such difficulty and such Orders shall be laid before Parliament.

NC demands Suu Kyi's release

The Nepali Congress Wednesday demanded the immediate release of Myanmar pro-democracy leader Ang San Suu Kyi. The party, in a statement, denounced her arrest along with her party associates.

Thapa's appointment stirs controversy

Constitutional experts have termed the recent move of King Gyanendra to appoint Surya Bahadur Thapa as the new Prime Minister of being faulty and claimed that the repeated use of Article 127 of the Constitution would lead the country towards further confusion and chaos, published reports said.

Talking to the Nepal Samacharpatra daily, former Supreme Court Justice Laxman Prasad Aryal said the King has used the Article 127 to appoint Thapa to the post of PM but he should not have done so.

"The political parties had forwarded the name of their consensus candidate, the King instead of appointing the PM as per their wish rose above the Constitution and made the appointment as per his own wish, which is objectionable," Aryal told the daily.

The constitutional crisis in the country would have been addressed to some extent if the King had formed an all party government under Article 128 of the Constitution, Aryal said. Senior advocate Ganesh Raj Sharma said the King had acted arbitrarily by appointing Thapa as the new PM under Article 127 of the Constitution. 

Another senior advocate Mukunda Regmi who was one of the members of Constitution drafting committee said there isn't any difference between the government headed by Chand and the government to be headed by Thapa. nepalnews.com am June 5


Norms of constitutional monarchy violated: Nepal

The undermining of the recommendation of 96 ex-members of parliament to appoint their consensus candidate to succeed Chand as PM by King Gyanendra has led to the violation of the norms of constitutional monarchy, UML General Secretary Madhav Kumar Nepal said Wednesday.

Nepal's name had been recommended by the five agitating political parties to be Chand's successor. "The recent move of the King to appoint Thapa as PM has indicated that the King still has undemocratic attitude," Nepal told the Nepal Samacharpatra daily immediately after the appointment of Thapa as the new PM.

Nepal said his party would not support the Thapa government. He said that his party would now step up the anti-King protests to 'restore the democratic rights' of the people. nepalnews.com am June 5


Students unions stage demonstration

Student bodies of the five agitating political parties demonstrated in the capital Wednesday immediately after the announcement of the appointment of Surya Bahadur Thapa to the post of Prime Minister.

The student unions affiliated to the five political parties staged a demonstration against the Royal move at Ratnapark Wednesday evening showing black flags and chanting anti-King slogans.

The students blocked the traffic for half an hour. The students have announced that they will give continuity to the protests. The five agitating political parties will meet Thursday to chalk out their

Capital's air quality not up to mark: Report

Poor road conditions coupled with inferior quality of gasoline and increasing number of vehicular traffic in the valley have led to the deterioration in the air quality, which according to a study carried by the
Ministry of Population and Environment is far below the set standard.

The study carried out in five different places of the valley-Patan hospital, Putali Sadak, Bhaktapur, Tribhuvan University and Matsyagaon has revealed that the air contains particulate matters of diameter less than or equal to 10 micrometer, which is more than the proposed air quality standard. The Ministry has monitored the air quality in the said areas from May 25 to 31. nepalnews.com am June 5


King has cleared political issues: PM Thapa

Prime Minister Surya Bahadur Thapa said Wednesday the "King has cleared" the issued raised by the opposition with whom he will seek a dialogue to end the current "dangerous crisis in the country." 

Thapa made the comments while talking with reporters at his residence soon after his appointment for the fifth time as prime minister in more than three decades. (biodata)

'The political issues have been cleared. This should be the basis for the start of national reconciliation," he said. Thapa said the royal message addressed issues of the government's executive powers and an all party government. 

He said his government will give top priority to resolve "outstanding issues" such as peace talks with Maoists in a "strengthened manner to give it momentum" and "good governance." 

"The priority is to talk with the political parties and move ahead with their support," Thapa said. "There is no dispute now." Outgoing Prime Minister Lokendra Bahadur Chand said he will support his successor. 

Formal joint reaction of the five opposition parties waging anti-King protests will come only when they meet Thursday; the parties could not meet Wednesday because of the ill health of the mother of CPN-UML General Secretary Madav Nepal. 

The five parties have announced the fourth round of their anti-King protests that has entered its fourth week. But individual comments of Nepali Congress and CPN-UML leaders were not favourable. 

"The appointment is an attempt to detail the movement," central committee member of the Nepali Congress and former home minister Ram Chandra Paudel said. Party spokesman Arjun Narsingh K.C. said the party will not join the Thapa government and the movement will continue. 

"This is a let down. The appointment was made without consulting political parties," central committee member of the CPN-UML Ishwor Pokhrel said. 

"There will be no party support. Let us see the government formation and how it functions," spokesman of the Nepali Congress (Democratic) Hom Nath Dahal said. nepalnews.com br June 4


Maoists react to Thapa's appointment

Maoists will not sit down at the negotiating table for the third phase of talks with the Government until their political demands presented at the second round of talks last month are met, a rebel leader at the contact office in Kathmandu who did not want to be identified by name said. 

"Our outlook is the same. Thapa is a representative of the old regime and the King's representative,' he told Nepalnews over telephone.

Three dacoits killed

Three Indian dacoits were killed overnight in an encounter with police at Barganda village in no man's land along the Indo-Nepal border in Morang district, Radio Nepal said quoting police Wednesday. 

A gang fled across the border with the dead leaving behind two crude guns, some bullets and other weapons. Police did not suffer any casualties in the encounter along a river bank, the Radio said. nepalnews com br June 4


India gifts 16 ambulances

The Indian Embassy Wednesday gifted 16 ambulances worth NRs.13 million to various municipalities and non-profit organizations, the Indian Embassy said. 

Chief Secretary Dr. Bimal Prasad Koirala handed over the keys of the ambulances to representatives of the selected organizations. 

Between 1994 and 2002, India has gifted 29 ambulances to Nepal; altogether 45 organizations have so far received ambulances under the programme. nepalnews.com br June 4


Nepal committed to peace: King

King Gyanendra said Wednesday progress has been made in restoring peace in Sierra Leone where Nepali peacekeepers have been deployed under the United Nations. 

The King said the deployment of Royal Nepal Army soldiers in the west African state while managing peace at home reflected Nepal's desire and commitment to international peace.

The King said this Wednesday in a message to the departing 4th contingent of the Pashupati Battalion peace force assigned to the United Nations to the west African state of Sierra Leone.

Thapa succeeds Chand (5:00 PM)

King Gyanendra Wednesday appointed Surya Bahadur Thapa Prime Minister to succeed Lokendra Bahadur Chand who resigned last Friday, the Royal Palace said.

The King nominated Thapa after seven political parties failed to recommend a consensus candidate five days after a collective meeting with the King who said he would endorse their common choice. 

The King rejected the nomination of General Secretary Madav Kumar Nepal of the CPN-UML suggested by four opposition parties who have launched protests against him for alleged "regressive" actions after sacking Prime Minister Sher Bahadur Deuba on October 4 last year after assuming executive powers. 

The King made the fresh government move exactly two years after he ascended the Throne after the
deaths of his brother, King Birendra and nephew, King Dipendra whom he succeeded. 

The Palace called Thapa, leader of the Rashtriya Prajatantra party. King has asked Thapa to form a government by including other political parties "as far as possible."

No timeframe for new govt.

The King did not give Thapa any timeframe to assemble a new government. The King has also issued an order that the government will enjoy executive power under article 35 of the constitution.
