SC issues notice on British Gurkha deployment 

The Supreme Court (SC) on Wednesday issued a show cause notice to the Prime Minister’s Office and the government asking why the British government was sending British Gurkhas to Singapore and Brunei after recruiting them in the British army.

Following a hearing on public interest litigation (PIL), a single bench of justice Badri Kumar Basnet issued the show cause notices. The apex court moreover, directed the Foreign Ministry, and the Ministry of Law Justice and Parliamentary Affairs to clarify the issue.

Advocate Om Prakash Sharma had filed a writ petition in the SC alleging the British government for ‘illegally sending the British Gurkhas recruited in the British army to other countries. The tripartite treaty between Nepal, India and Britain regarding the recruitment does not allow the British government to send British Gurkhas to serve in other countries than Great Britain.

Similarly, the same bench issued another notice to the PMO and Ministry of foreign Affairs (MoFA) in response to a writ petition filed by Gurkha Army Ex-Servicemen’s Organization (GAESO). The GAESO on Tuesday had filed a writ petition at the SC seeking an order to the PMO and MoFA, to make their stance regarding the GAESO’s demand public on whether ex-Gurkhas should receive equal pension as their British counterpart.

GAESO President Padam Bahadur Gurung and Secretary Mahendra Lal Rai had filed the petition. nepalnews.com pd Dec 30 04
