A writ petition challenges CA's decision of implementing republic
Stating that an incomplete assembly cannot implement the declaration of
republic, a writ petition has been filed at the Supreme Court (SC) on
Monday.
Ram Kumar Ojha representing Nepali Janata Dal filed the petition at the apex
court contesting the legitimacy of the decision made by 'incomplete' CA.
Although the interim constitution has provisioned for 601-member strong CA,
the first meeting of the CA, which was held on May 28, only had 564 members
of which 560 members had voted in favour of republic implementation. The
government had failed to nominate the 26 members for the CA.
The petitioner has asked the apex court to cancel the CA decision.
