Hearing on writ against CA decisions postponed again
Hearing on the writ petition filed in the Supreme Court (SC) challenging the decisions taken by the first sitting of an "incomplete" Constituent
Assembly (CA) was put off for the second time Thursday.
The hearing on the writ which is to be presented before the single bench of Chief Justice (CJ) Kedar Prasad Giri was postponed following a request from Nepal Bar Association, which organised protests today against the killing of a lawyer by an armed group in Bara recently.
Stating that an "incomplete" assembly cannot implement the declaration of republic, advocate Ram Kumar Ojha, representing Nepal Janata Dal, had on Monday filed the petition at the apex court questioning the constitutionality of the decisions of the CA that did not have 26 members
that needed to be appointed by the cabinet.
The petition demands scraping of procedures including the implementation of republic carried out without full Constituent Assembly (CA) members. Although the interim constitution has provisioned for 601-member strong CA, the first meeting of the CA, which was held on May 28, had 564 members of which 560 members had voted in favour of republic implementation. The government had failed to nominate the 26 members for the CA.
The petitioner has asked the apex court to call the CA decision null and void. nepalnews.com ag June 05 08
