CHIEF Justice Keshav Prasad Upadhayaya inaugurated a one-day seminar on implementation of verdicts of courts in Kathmandu the other day in which he said that verdicts of the courts need to be enforced effectively. According to Chief Justice Upadhayaya, peoples faith in the judiciary would wither away if the verdicts of the courts are not enforced and implemented in time and if people do not benefit from courts decision. Similarly, Chief Justices remarks carry an important message to the judges in that they should work more devotedly in order to properly deliver justice and raise the peoples faith in the court. There have been instances in the country when some people took to steets raising the question of courts independence and efficiency when the verdict of the court was not as they so desired. This tendency could weaken the independence and efficiency of the court and the entire justice delivery system. There are also examples of some organisations even delaying to implement the court verdicts for years, as a result the victims suffer twice. As such, some people are of the view that it would do well if the court itself fixed the time frame to implement the decision of the court. The remarks of Chief Justice for effective enforcement of court verdicts therefore should be taken to a heart by both the judges and people alike. In the same way, peoples respect for the court also depends upon the behaviour, competence and judgement of the judges. Judges themselves need to remain cautious to maintain the independence and competence of the judiciary since it is the custodian of peoples rights and the institution through which the people get justice. Judiciary, thus, needs to maintain faith of people by delivering justice quickly and properly. There have been complaints that people sometimes have to wait for years to get justice in certain cases. Since justice delayed is justice denied, judges need to give due attention towards this concern of the people as well. As the country is facing numerous problems in all fronts, judiciary also may not be free from problems and constraints. But this should by no means affect the timely justice delivery system. There have also been demands to bring about reforms in the judicial sector in order to make the process of justice delivery more effective. Such an initiative should and must to come from judges themselves because they are the ones who know more than others the problems and constraints of the court and judicial processes. Other Story |
