Expedite Justice

CHIEF Justice of Supreme Court Keshav Prasad Upadhyaya underlined the need for making Nepal’s justice system more effective and reliable so that people have easy and quick access to justice. Inaugurating the fourth central conference of public prosecutors, government advocates and legal officers of His Majesty’s Government the other day in Kathmandu, Chief Justice Upadhyaya called upon public prosecutors and legal officers to work more effectively and efficiently to make justice system prompt, effective and accessible to the general people. Judiciary is the custodian of people’s rights and rule of law. Judges are the ones who act on behalf of judiciary to dispense justice to the people. Public prosecutors, lawyers and legal officers help judiciary in the act of dispensation of justice in a quick and effective manner. It is said that justice delayed is justice denied. The duty of judges is to dispense justice quickly and the role of public prosecutors and other lawyers is to help the judiciary in this act. We have multi-party democracy, independent judiciary and rule of law. It is the judiciary and judges that translate the constitutional provision of rule of law into reality. Unless the justice is dispensed in time, people may not have the feeling that justice has been done to them. There are complaints regarding delay in the dispensation of justice. Chief justice Upadhayaya and other judges have time and again expressed concern over it and have expressed their commitment to make the justice dispensation system quicker. As stated by the Chief Justice Upadhyaya, the problem is more with the criminal justice administration. There are some lacuna and shortcomings in the justice system in Nepal, which need to be corrected in order to fully realise the constitutional provision of rule of law. Several factors may be behind this situation. Efficiency of judges is the key factor for quick and effective dispensation of justice. The efforts to enhance efficiency of judges need to be carried out and reforms in legal system could be another step to make justice delivery system quicker, more effective and people oriented. After the restoration of democracy in 1990, several measures have been taken to strengthen the capability and efficiency of judiciary and judges to make the justice system more reliable. However, there is still no room for complacency. Further efforts need to be made in order to make our justice system more efficient and reliable. For this, role of judges, public prosecutors and other lawyers is crucial.
