Annual Survey of Nepalese Law 2000 Law Under Scrutiny NBC's annual book brings out opinions of different lawyers on various legal issues By KESHAB POUDEL In the history of last five decade practices of modern judiciary, Nepalese judiciary has set many precedents and has interpreted laws and constitutional provisions. Strangely, only a few such decisions were translated in English and major efforts have not been made to bring those interesting decisions to the global legal community. The credit for publication of Nepalese judiciary's decisions goes to Nepal Law Society which started with Law Bulletin quarterly from 1983. The quarterly is still the only regular publication of Nepalese legal sector. After publication of Annual Survey of Nepalese Law, there is now another choice to know and understand the judicial decisions and legal interpretations. Although Annual Survey of Nepalese Law 2000 is a first effort to bring all major decisions in one volume, it will help foreign researchers to see what major achievements have been made by Nepalese judiciary. Altogether 13 articles are included in the annual survey. With an objective to provide readers with a comprehensive view of Nepalese laws in selected fields, the book includes the articles of research-oriented lawyers. The aim of the annual book is to bring out legislative and judicial developments of a subject in the preceding year but the first edition is not restricted to any particular area. From prominent corporate lawyer Bharat Raj Upreti's analysis on Company Law in Nepal and Dr. Amber Panta's overview of Environment Law in Nepal to Madhab Paudel's Legal Framework for Foreign Investment in Nepal, all articles are argumentative and based on the decisions taken by Nepalese courts at different times. Bishal Khanal's A Brief Review of the Structural Development of Nepalese Laws highlights how Nepalese law had evolved with the time. Purna Man Shakya's Critical Analysis of Constitutional Development of Nepal and Sonali Regmi's Status of Women Under the Present Legal system are also interesting to read. Dr. Bharat B. Karki's The Law of Labor - Management and Relations in Nepal, Dr. Hari Bansh Tripathi's right to Constitutional Remedies and its Judicial Interpretation also highlighted labor aspects and judicial interpretation. Payment System and Development of Banking Law in Nepal and Phanindra Gautam's Law of Contact are some other articles that highlight legal systems in these sectors. Kailash Prasad Subedi's Right to Property Under the Constitution of Nepal and in Nepalese Law: A Survey, Overview of Law of Homicide in Nepal: Modern Context are other important articles. The arguments and opinions in the articles are full of discussions referring to particular cases related to the subjects. Some of the articles in the book are contradictory to each other but the book as a whole is very informative and useful. |
