I am in favor of girls enjoying property rights

Ms. Sirjana Sharma ( Dhakal) is a resident of Kathmandu who has recently secured the Masters Degree in Law and could be considered among the few girls who have been able to obtain this degree in the country.

Ms. Sharma is currently associated with the office of the Creative Law Associates based in Babar Mahal. Needless to say she is practicing various cases at the Courts.

Ms. Sharma has to her credit various training experiences that include among others, Professional Skill Training Program (ILRR); Training on Labor Laws (FNCCI and IRF); Basic Layering Skills Development Training Program (NBA); Training On Labor Act (NBC); Training On Torture ( CVICT); Training for lawyers on Environment Laws (NBA); Masters of Ceremony Training ( Bhaktapur Jaycees)

Training for lawyers on Biodiversity Conservation in Nepal (NBA); One Day Training on " Domestic Inquiry and Disciplinary Action" on National Labour Academy ( NBA)

Similarly, her profound experience in the legal profession include, practiced as a Legal Assistance in Kanuni Sewalaya, Jayabageswari, Kathmandu (2054 Shrawan to 2057 Paush ); Legal Aid officer in Helping Group for Helpless Prisoners (2056 to 2058); Worked as a researcher in Center for Human Rights, T.U; Involving as a legal officer in Sisters' Service Society (3S's Nepal); Working as a lawyer in Creative Law Associates, BabarMahal from 2059; Legal Consultant in Nepal Info Park Pvt. Ltd.

She is one of the promising girls who has entered into this profession and the nation can boast of her achievements. Kudos to you Ms. Sharma for your stupendous accomplishments.

Last week, we approached this new Lawyer, Ms. Sharma, and upon listening to her bright career and experiences, for an interview. Thanks Ms. Sharma couldn’t resist her temptations to talks to an english language weekly perhaps for the first time.

Below the results: Chief editor.

TGQ 1: You Ms. Sirjana have just obtained Masters in Law, we are told. As a member of the ‘female sex’ how you feel about your own degree? Also tell us in what ways you wish to serve the country?

S.Sharma: As a member of the female sex, I was lucky enough to get this opportunity to do masters degree in law. Rarely a woman in Nepal gets this opportunity. I must thank my family members from the core of my heart for giving me a chance and for the encouragement they provided during the course of my studies and believing in me to complete the LL.M. degree.

By getting this degree I got confidence in myself and my career also. Now I can build up my career through my own ideas and concepts. I change myself in my own study. Now I’m interested in updating my knowledge and build up creativity, analyze the subject matter also and thus will be able to give my ideas and concepts a concrete shape. Now I’m eager to know about the emerging issues in the country in the legal domain.

I’ll serve my country from the professional field where in I am today and I think that I can do a lot together with my colleagues for the country. I can’t tell you at this moment about how I will be of some support to the cause of the nation but what I can assure you that I will definitely do that because it had been a desire in my mind to serve the needy ones of the country.

Apart from that I also wish to serve our nation which is definitely a small part of the global village through the sound legal mechanism in the industrialized world.

TGQ 2. How you look at the ‘feminist’ movement now going on in the country?

Do you subscribe to the view that girls too be allowed to share parent’s property? Or you differ with this notion? What sort of social impact it would have on the society if girls too enjoy the property as per the law? Your remarks please.

S.Sharma: The on going feminist movement in our country is very much appreciable. We must appreciate the on going feminist movement of our nation because it has come up with a new concept. Each and every steps that have been taken up the government and the other sectors is a welcome move, I must say. At least they are encouraging the woman in each and every aspect of their sustainable development. But we must also not forget the grassroots woman who is not getting this kind of opportunity. So we must now keep the movement on till the women in the remote villages benefit from this movement.

I don’t really differ from them. I am in favor of the women or for that matters the girls should get a share in her parent’s property. They must enjoy the parents’ property as their brothers do as inheritance. I am hopeful that the society would follow the laws of the land and provide responsibilities to the women folks. Here again I strongly believe that if the women folks are granted responsibilities they can shoulder that without any problem. They are really competent enough and know how to share the burden of the society and the nation at large. However, the girls too must not forget their responsibility regarding the family member(s).

TGQ 3: What is the state of the women in Nepal? Do you think that the women of the country have been denied their role, status and responsibility in the affairs of the nation? If allowed will this section be able to shoulder this responsibility?

S.Sharma: Now at the moment, the status of women in Nepal stands at a very low level at the policy and decision making processes. They are not getting such kind of opportunities at the higher level. Current situation of our society has denied the woman its due and the rightful role to serve at the higher levels of policymaking and decision making processes. It’s really shocking indeed. If they get the chance at the policy making level, I am confidant, they can do very well and also can succeed to address various women’s issues confronting them. If granted the role, they can not only exhibit their talent but can also serve the country better being at par with their male counterparts.

TGQ4: You have specialised in Commercial law. What it is all about? Also tell us the sphere and scope of your degree in the country? Your comments please.

S.Sharma: Commercial law is all about the issues related to trade /commerce and business. It is related to those laws, which governs the corporate governance. Basically it follows two aspects in policy level, law making mechanism and at the advocacy level pleading and defending the commercial cases and consultancy in Company/ Corporation.

It is a wide subject, which I can’t explain you in few words. But the gist is that what I mentioned above.

TGQ5: How you Ms. Sharma view the mushroom growth of NGOs that claim to work for the betterment of the women’s affairs. Have they done well in this regard or simply been earning dollars? Your exclusive comments please.

S.Sharma: NGOs/INGOs are trying their best to address the problems and the issues of the women folks of the country. But some how or the other they appear to have failed in their pious mission because of their very low concentration at the grassroots level. Most of the NGOs are advocating the policy level at the top but they never care to observe the state of the women folks at the grassroots level. They must follow the Down-Top Theory. Most of the NGOs are a Himalayan failure because of the Top-Down theory they have been adopting till now to the best of my knowledge.
